TalkBuddy Terms and Conditions

Welcome to TalkBuddy. These Terms and Conditions ("Terms") govern your access to and use of the TalkBuddy mobile application, website, and related services (collectively, the "Service").

By creating an account, accessing, or using TalkBuddy, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

About TalkBuddy

TalkBuddy is an AI-powered English speaking and communication improvement platform that helps users improve fluency, vocabulary, pronunciation, and communication skills through guided practice, assessments, and personalized feedback.

Eligibility

You must be at least 13 years of age to use TalkBuddy. Users under 18 should use the Service only with the consent and supervision of a parent or legal guardian.

By using TalkBuddy, you represent that you have the legal capacity to enter into these Terms and that the information you provide is accurate and complete.

Account Registration

To access certain features, you may need to create an account. You agree to:

  • Provide accurate and up-to-date registration information
  • Maintain the confidentiality of your login credentials
  • Notify us promptly of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

Use of the Service

TalkBuddy grants you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial learning purposes. You agree not to:

  • Use the Service for unlawful, harmful, or fraudulent purposes
  • Attempt to reverse engineer, copy, scrape, or exploit the platform
  • Interfere with the security, performance, or integrity of the Service
  • Upload or share abusive, offensive, or infringing content
  • Misuse AI features to generate harmful, misleading, or illegal content
  • Share account access with others or resell Service access without permission

AI-Powered Features

TalkBuddy uses artificial intelligence to provide speaking practice, pronunciation feedback, scoring, and learning recommendations.

AI-generated feedback and scores are provided for educational purposes only. They may not always be perfectly accurate and should not be treated as professional, legal, medical, or employment advice.

You understand that your voice, transcripts, and practice interactions may be processed to deliver these features, as described in our Privacy Policy.

Subscriptions, Credits, and Payments

Some features of TalkBuddy may require payment, credits, talktime, or a subscription plan. Prices, packages, and available features may change from time to time.

Payments are processed through approved third-party payment providers. By making a purchase, you agree to the pricing and billing terms shown at checkout.

Unless otherwise required by applicable law or explicitly stated at purchase, fees are non-refundable once services or digital credits have been delivered or used.

Learning Content and Intellectual Property

All content, software, branding, course materials, assessments, reports, and technology on TalkBuddy are owned by TalkBuddy or its licensors and are protected by applicable intellectual property laws.

You may not copy, distribute, modify, sell, or create derivative works from any part of the Service without prior written permission.

You retain ownership of content you submit, such as voice recordings and practice responses, but grant TalkBuddy a limited license to process that content solely to operate and improve the Service.

User Conduct

You are responsible for your use of TalkBuddy and agree to use the platform respectfully. We may review activity where necessary to:

  • Protect users and platform security
  • Prevent abuse or misuse of AI features
  • Enforce these Terms
  • Comply with legal obligations

We may suspend or terminate access if we reasonably believe a user has violated these Terms or applicable law.

Service Availability

We strive to keep TalkBuddy available and reliable, but we do not guarantee uninterrupted or error-free operation.

We may modify, suspend, or discontinue any part of the Service at any time, including features, courses, pricing, or content, with or without notice where permitted by law.

Disclaimer of Warranties

TalkBuddy is provided on an "as is" and "as available" basis to the fullest extent permitted by law.

We do not warrant that the Service will meet every learning goal, produce specific outcomes, or be free from errors, delays, or interruptions.

Limitation of Liability

To the fullest extent permitted by law, TalkBuddy and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claim relating to the Service shall not exceed the amount you paid to TalkBuddy in the twelve (12) months preceding the event giving rise to the claim, or such minimum amount as required by applicable law.

Account Termination

You may stop using TalkBuddy at any time. You may also request account deletion through the app or by contacting support.

We may suspend or terminate your account if you violate these Terms, misuse the Service, or if continued access creates legal, security, or operational risk.

Upon termination, your right to use the Service will end, subject to any data retention requirements described in our Privacy Policy.

Third-Party Services

TalkBuddy may integrate with third-party services such as authentication providers, analytics tools, payment gateways, cloud infrastructure, and AI processing services.

Your use of those services may be subject to their own terms and privacy policies. TalkBuddy is not responsible for third-party websites or services outside our control.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India, unless otherwise required by applicable law.

Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on our website and within the application.

Your continued use of TalkBuddy after changes become effective constitutes acceptance of the revised Terms.
